Q&As
What is Mediation?
Mediation is an alternative to resolving disputes outside of court. It is efficient, cost-effective and confidential and the parties have full control over the process and the outcome.
Mediation is a voluntary process whereby a mediator who is a neutral third party assists the participants to a dispute in exploring their issues and facilitates the negotiation process so that the parties can create solutions themselves and negotiate a mutual settlement agreement.
Why Mediate?
Mediating your dispute is the right decision for you, if you are:
- looking for a cost-effective solution;
- wishing to avoid the stress that comes
with litigation in court;
- looking for an efficient, creative and
valuable solution; and
- wishing to preserve your and your
opponents relationship.
Why should you submit your dispute to Online Mediation?
-The mediation is with a highly specialised
accredited civil/commercial and online
mediator;
- you save time, money and energy;
- you can participate from the comfort of your
own home, office or car;
- you can participate from anywhere in the
world, where you have a good internet
connection; and
- it is a flexible and efficient process.
How does Online Mediaton work?
Online mediation can be accessed via a tablet or computer. Furthermore, each party can participate from the comfort of their own home, office or even a car via zoom.
A zoom call allows everyone to see and speak to one another without having travel to the same place.
The only thing required, is a solid internet connection.
Who will the Mediator be?
An ADR ODR International dual qualified Civil/Commercial and Online Mediator will be assigned to your mediation.
All of our mediators have been trained to remain fair, impartial and neutral to both parties through-out the mediation.
It is important to remember that a mediator is not a judge, therefore, he or she will not adjudicate on issues to find if parties should accept a position or an offer irrespective of whether those relate to facts or the law. The mediator will solely guide the parties towards a mutually acceptable outcome.
How much does it cost?
Your mediator will provide his services pro bono and ADR ODR International will charge each party an administrative fee.
If the value of your claim, is between Rs. 0 - 499,999/- the administrative fee
will be Rs. 7700./ per party.
If the value is Rs. 500,000 or more, the National Online Pro Bono Mediation Service does not apply.
How long does it take?
Each online mediation via our National Pro Bono Mediation Service (UK) should last up to maximum 3 hours.
Should the parties wish to go over the time they will be subject to an extra fee, which will be outlined in the mediation agreement to be signed by both parties prior to the online mediation.
What do you need to do?
The only thing that you will be required to do is to complete our online booking
form and submit your and the opposing parties' details once you both have agreed
to going ahead with the mediation.
Once your form is received, one of our team experts will e-mail the relevant parties available dates
and once the date for the online mediation has been agreed by the both of you the team will send you both invoices.
Once the fees have been settled you the party whose fee has arrived in our account first will be asked (via e-mail) to sign the online mediation agreement
first.
What about Zoom?
All you have to do is download Zoom - https://zoom.us/. Once you have your account created you can hold any conferences on it online.
The mediator will only create a link, which will be an invitation for both of the parties to join (on the day scheduled for the mediation) closer to the time of that date. This could be as late as a day before the online mediation. Therefore, please do remain patient.
Once you get the link via e-mail you will be able to click that and it will bring you to the Zoom platform, however, this will only work at the exact time and on the agreed date for the online mediation.
