With over 11 years of commercial litigation experience behind me, I am a huge advocate of mediation and ADR especially in the agricultural, contested estates, trusts and probate arena. After many years of participating in successful mediations, I now mediate disputes bringing “good legal knowledge and an effective blend of charm, good humour and steely resolve” to the process. I provide expert services with active mediator involvement to resolve and conclude disputes. Being CEDR accredited and having co-mediated with and observed some of the top mediators in the country, I have a strong skill set in mediation techniques.

I mediate all kinds of civil and commercial disputes. My niche area of practice is chancery work with a specific focus on proprietary estoppel, contested probate, trusts and estates. My in depth knowledge of the law and understanding of the personal and emotional aspects of these cases, allows me to mediate such disputes with specific expertise to the sensitive issues involved.

Style & Approach

I have significant experience in all stages of litigation from pre action matters to lengthy trials in the Chancery Division at the RCJ and on into the SCCO. Sam therefore is best placed to challenge parties to think about the worst case scenario at trial, allowing parties to test the strength of their respective cases and consider the various outcomes at trial including the impact of costs orders. I actively involves myself in discussions regarding the commercial reality of litigation and the unpredictability of trials.

Given my background in proprietary estoppel, contested probate, trusts and estates, I have a special interest in promoting pre action mediation in these circumstances. Disputes involving families and inheritance can escalate rapidly increasing costs and decreasing the overall pot over which everyone is fighting. I believe that such escalation can be avoided by mediating early.
