Finalist of the BPP Leeds ADR Competition in 2018
The ADR competition was held during my BPTC year at BPP Leeds. It involved the participation of all BPTC, LPC and GDL full-timers and part-timers. The first round included negotiation on a nuisance neighbour dispute. The second round was based on mediation. I had to resolve a nuisance dispute using the facilitative style of mediation.
Style & Approach
My forte lies in being open minded and understanding. I do not judge and give opinions. I do not use my legal background against the parties. I do not come to a solution as to the dispute in my own mind and try to use it to influence the parties. I am ready to use my legal background only when parties ask me to adopt an evaluative mediation style. I am a mediator who understands and receives the state of mind of a party in dispute. I facilitate the communication between parties by being compassionate and trustworthy. I aim for parties to see me as worthy of being a recipient of their words and documents. As a mediator, I guide parties to think about all possible solutions, solutions which are commercially beneficial to them and those out-of-the-box solutions.
Altogether, I balance the above with my professionalism and sense of ethics. I understand and adhere to confidentiality. I am a through professional, I am punctual, I understand the commercial and civil worlds in which parties belong and I like to work efficiently and effectively. Whilst putting parties and their dispute solving as my priority, I remain neutral, impartial, ethical and independent. Also, I am a mediator who thinks of those little extras-like providing refreshments, giving breaks and mediating in a good positive environment.
